ACC issues response to FSU's North Carolina Supreme Court Appeal
The ACC has presented its case to dismiss Florida State's appeal to the North Carolina Supreme Court.
In the conference's 68-page filing, the ACC argued that FSU's appeal to overturn the denial of a motion to stay made by Judge Louis Bledsoe in Mecklenburg County Court, saying the school doesn't meet the requirements for that decision to be overturned.
FSU's argument centered around its belief that the ACC filed preemptively in North Carolina, something that Leon Judge John C. Cooper felt was true, but Judge Bledsoe disagreed in his April decision to deny the motion to stay. The school appealed in June, and in the conference's response it said FSU's appeal "fails on its face" as it doesn't prove that the court's decision was “patently arbitrary."
In its filing, the ACC doubles down on its statement that it didn't do anything wrong, citing that the Mecklenburg County court ruled the conference had the right to sue a member school in North Carolina, the location of the ACC's headquarters, about a North Carolina agreement.
The response comes just two days after FSU scored a win in Leon County Court with Judge Cooper denying the ACC's motion to dismiss the lawsuit on the grounds of personal jurisdiction. While the hearing and ultimate decision on a case dismissal is yet to come from Cooper, the issue of jurisdiction was a massive hurdle in the case.
