Bengals RB Joe Mixon's 'aggravated menacing' charge dismissed for additional investigation

The case filed on Thursday against Bengals running back Joe Mixon was dismissed on Friday morning.

The prosecutor's office told Hamilton County Judge Curt Kissinger that the city has requested the case be dismissed because additional investigation is needed to move forward with the case. The alleged victim has been in communication with the Cincinnati police and, according to the Hamilton County Prosecutor's Office, wants to move forward with the charge if the prosecutor's office decides to refile the case.

The judge dismissed the charge and recalled the warrant for Mixon’s arrest, subject to further filing by the city of Cincinnati.

The arrest warrant was issued after Mixon allegedly pointed a gun at a woman in downtown Cincinnati last month. According to the court documents, Mixon said, “You should be popped in the face, I should shoot you, the police [can't] get me.”

The misdemeanor warrant was for one count of aggravated menacing, a charge in Ohio that states a person shall not knowingly “cause another to believe that the offender will cause serious physical harm to the person or property of the other person, the other person's unborn, or a member of the other person's immediate family.”

Mixon's agent, Peter Schaffer, expected the misdemeanor charge to be dropped, adding that “it was a rush to judgment,” via NFL Network's Tom Pelissero.

The 26-year-old had 814 rushing yards and seven touchdowns last season, his sixth with the Bengals. He had 19 rushing yards on eight carries, along with three catches, in the Bengals’ loss to the Kansas City Chiefs in the AFC championship game.

According to officials, the incident occurred just one day before the team’s divisional round playoff game against the Buffalo Bills in New York.

Mixon has been charged with a misdemeanor in the past. Mixon was suspended for a season while at the University of Oklahoma in 2014 after he was seen on video punching a woman at a sandwich shop near campus. He then spent two seasons playing for Oklahoma before the Bengals selected him with the No. 48 overall pick in 2017.

“The club is aware misdemeanor charges have been raised against Joe Mixon,” the Bengals said in a brief statement on Thursday, via Fox 19’s Jeremy Rauch. “The club is investigating the situation and will not comment further at this time.”
