2017 Yahoo Sports Survival Football $100K Contest OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  

1. Eligibility: 2017 Yahoo Sports Survival Football $100K Contest (“Contest”) is a contest of skill that is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old. Employees, officers and directors of Sponsor, HelloWorld, Inc. (the “Administrator”) or any of their parent or affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, officer or director (whether related or not) are not eligible to win a prize in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. 

2. Sponsor: Oath Holdings Inc., 701 1st Ave., Sunnyvale, CA 94089. Administrator: HelloWorld, Inc., 3000 Town Center, Suite 2100, Southfield, MI 48075.

3. Agreement to Official Rules: Participation in the Contest constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor's and Administrator's decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. Timing: The Contest begins on August 10, 2017 at 3:00:00 p.m. Pacific Time ("PT") and ends on December 31, 2017 at 10:00:00 a.m. PT (“Contest Period”) and is comprised of seventeen (17) rounds (each a “Round”) as set forth in the table below:

 *Picks for a Round’s Thursday game(s) must be submitted before the start time of the first Thursday game played that Round. Picks for a Round’s Saturday game(s) must be submitted before the start time of the first Saturday game played that Round.

Sponsor's computer is the official time-keeping device for the Contests.

5. How to Register for Contest: Prior to 10:00a.m. PT on September 10, 2017, visit https://football.fantasysports.yahoo.com/survival?utmpdku=1 and follow the links and instructions to sign-up for the Contest. If you do not have a Yahoo Fantasy account, you may visit www.yahoo.com to create a free account to participate in the Contest.

6. How to Participate:

For Rounds 1-13, visit https://football.fantasysports.yahoo.com/survival?utmpdku=1 during each Round and follow the directions to submit your pick of the one (1) Pro Football team that will win its game during that Round; and

For Rounds 14-17, visit https://football.fantasysports.yahoo.com/survival?utmpdku=1 during each Round and follow the directions to submit your pick of two (2) Pro Football teams that win their games during that Round.

You may only pick each Pro Football team ONCE during the Contest Period. Once a Pro Football team is selected as your pick in a Round, it cannot be selected as your pick in a subsequent Round.

You must submit the required number of picks each Round and each Round’s pick(s) must be submitted during the Round’s time period as set forth in Section 4. Failure to submit the required number of picks each Round within the indicated time period will result in elimination from the Contest.

Limit: You may only register for the Contest one (1) time during the Contest Period. Registrations received from any person or email address in excess of the stated limit will be void. Entries generated by script, macro or other automated means are void. In the event of a dispute regarding any registration, the authorized account holder of the email address used to register will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being an authorized account holder.

7. Winner Determination: After the conclusion of each Round, the Sponsor will determine the participant(s) who correctly chose winning team(s) during that Round and those participants will advance to the next Round. Participants who chose a losing team during any Round are eliminated from the Contest and do not advance to the next Round. Participants who chose a team whose game ended in a tie are eliminated from the Contest and do not advance to the next Round. The participant(s) who advance the furthest in the Contest, in the Sponsor’s sole discretion, will be deemed the potential winner(s) of the Contest.

8. Winner Requirements: Potential winner(s) will be notified by Administrator by email on or around January 22, 2018. If the prize for the/each potential winner of a prize equals Six Hundred Dollars ($600) or more (parent/legal guardian if a winner is a minor in his/her place of residence), the/each potential winner will be required to sign and return a Declaration of Eligibility, Liability Waiver and where not prohibited, a Publicity Release ("Declaration"), which must be received by Administrator, within Seven (7) of the date notice was sent in order to claim his/her prize. If the prize for each potential winner equals $599.99 or less, each winner will be required to provide his/her name, home mailing address, birthdate and phone number (for prize fulfillment purposes) within seven (7) days of the date notice was sent in order to claim his/her prize. If a potential winner cannot be contacted, fails to sign and return the Declaration or provide other requested information within the required time period (as applicable), or does not comply with these Official Rules, the potential winner forfeits the prize. If a potential winner is disqualified for any reason or forfeits the prize, the prize will be divided amongst the remaining potential winners. If the/every potential winner forfeits the prize, the prize will remain un-awarded. Participation in a Contest and/or acceptance of any prize shall constitute and signify each entrant’s and winner’s agreement and consent that Sponsor and its designees may use the winner’s name, city, state, likeness, photograph, picture, statements about the Contests and/or prize information in connection with the Contests for promotional, advertising or other purposes, worldwide, in perpetuity, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.

9. Grand Prize:

ONE (1) GRAND PRIZE: One Hundred Thousand Dollars ($100,000). If there is more than one confirmed winner, the Grand Prize will be divided equally among all confirmed winners. The Grand Prize will be fulfilled, in Sponsor’s sole discretion, either as a check or as a VISA® Prepaid Reward. Card is issued by The Bancorp Bank, Member FDIC, pursuant to a license from Visa U.S.A. Inc. 

For All Prizes: Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Terms and conditions of VISA® Prepaid Rewards apply. Use your Visa Prepaid card anywhere Visa debit cards are accepted in the United States and U.S. Territories. The card may not be used at any merchant, including internet and mail or telephone order merchants, outside of the United States and U.S. Territories. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Limit: One (1) prize per person.

10. Release: By receipt of any prize, winners agree to release and hold harmless the Sponsor, Administrator and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, rights of publicity or privacy, defamation or portrayal in a false light, merchandise delivery, any activity or travel related to any Contest or from any interaction with, or downloading of any Contest information and any printing or typographical errors in any materials associated with any Contest, including any error that may give an erroneous indication that a prize has been won, arising out of participation in any Contest or receipt or use or misuse of any prize. EVERYTHING PROVIDED IN CONNECTION WITH ANY CONTEST IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES OR NON-INFRINGEMENT. In no event will a greater number of prizes than stated in these Official Rules be awarded. Some jurisdictions do not allow the exclusion of implied warranties on applicable statutory rights, so the above exclusions and limitations may not apply in some cases. 

11. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify any Contest, or any part of thereof, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of any Contest, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine the winners from among all non-suspect, eligible submissions received up to time of such action using the judging procedure outlined above. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the submission process or the operation of any Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated submissions. Any attempt by any person to deliberately undermine the legitimate operation of any Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 

12. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in any Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the submission process or any Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of any Contest, the uploading, the processing or judging of submissions, the announcement of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in any Contest or receipt or use or misuse of any prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third-party use of any submission. Further, the Released Parties are not responsible for any incorrect or inaccurate information, or by any of the equipment or programming associated with any Contest, or by any other technical or human error which may occur in the processing of registrations or entries into any Contest, or otherwise in connection with any Contest, including without limitation any technical limitation that results in the disqualification or loss of ranking status of any entrant into any Contest.

13. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with any Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or the appropriate California State Court located in Santa Clara, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with any Contest, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
